Terms of service for Convoh

1. Acceptance of Terms

​

1.1 By downloading, installing, accessing, or using Convoh(hereinafter referred to as "the App"), you agree to be bound by these Terms of Service (hereinafter referred to as "Terms"). If you do not agree to these Terms, please do not use the App.

1.2 These Terms constitute a legally binding agreement between you and Sircle Networking Pvt Ltd (hereinafter referred to as "we," "us," or "our") regarding your use of the App.

​

2. Eligibility

​

2.1 The App is available only to users in India who are 13 years of age or older. By using the App, you represent and warrant that:​

​

a) You are at least 13 years old;

b) You reside in India;

c) You have the legal capacity to enter into these Terms and be bound by them.

​

2.2 If you are using the App on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

​

3. App Features and Services

​

3.1 Social Media Features:

​

a) The App provides the following social media capabilities:

• Dual profile system (Real profile and Alt profile)

• Text posts and image posts from either profile

• Likes, comments, and shares on posts

• Profile anonymity for Alt accounts (other users cannot link Alt profiles to Real profiles)

• Custom offline status indicators (Ghosting, Inactive, Chilling, Brb, Away)

• Active status controls

• User visibility settings

• User blocking capabilities

• User search functionality

• Customizable wallpapers

• Multiple language support (English, Hindi, Telugu, Marathi, Gujarati, and Bengali)

• Dark and light mode options

• Multiple theme options (Normal, Pastel, Matcha, Lavender, and ButterBliss)

b) Real and Alt Profile System:

• Each user has one Real profile and one Alt profile linked to the same account

• Alt profiles are designed to be anonymous - other users cannot identify which Real profile an Alt profile belongs to

• Users can post, like, comment, and share from either profile

• When interacting from an Alt profile, your Real profile identity is not revealed to other users

• Other users may attempt to guess connections between Real and Alt profiles, but no identifying information is provided by the App

• Privacy settings apply separately to Real and Alt profiles

c) Post Visibility and Privacy:

• Users can control who sees their posts through privacy settings

• Posts can be public or restricted to specific audiences

• Alt profile interactions (likes, comments) do not reveal the user's Real profile identity

• We do not guarantee complete anonymity as users may identify patterns in behavior or content

​

3.2 Gaming Features:

a) Cricket Game:

• Play cricket matches against AI opponents

• Compete on a global leaderboard

• Leaderboard rankings are public and visible to all users

• Game statistics and scores are stored on our servers

• We reserve the right to reset leaderboards or adjust game mechanics

​

b) Swipe or Die:

• Answer yes/no questions by swiping

• See your rankings compared to users worldwide

• Question responses and rankings may be visible to other users

• We curate questions and reserve the right to remove inappropriate submissions

​

3.3 AI-Powered Features:

​

a) The App incorporates AI-powered features including:

• Chat with AI (Smart mode with web search capabilities and Work mode for STEM-focused assistance)

• Photo AI for image style transformation

• Notes app with AI generation and summarization capabilities

​

b) Chat with AI:

• Smart mode allows web search queries (daily limits may apply)

• Work mode is optimized for STEM-focused assistance

• IMPORTANT: All interactions with Chat with AI are sent to OpenAI for content improvement and service enhancement. This data sharing cannot be disabled and is a required part of using this feature

• If you do not consent to this data sharing, you must not use the Chat with AI feature

​

c) Photo AI:

• Upload your image and apply AI-powered style transformations

• Processed images are temporary and may be stored briefly for processing

• You retain ownership of uploaded images but grant us license to process them

• Results may vary and are not guaranteed to match expectations

• We are not responsible for unexpected or undesirable transformations

​

d) Notes with AI:

• Write personal notes within the app

• Use AI to generate note content based on prompts

• Use AI to summarize existing notes

• Notes are stored locally on your device

• We are not responsible for lost notes due to app deletion or device issues

 

e) AI Disclaimer:

• AI features are provided "as is" and may contain errors or limitations

• AI-generated content should not be considered professional advice

• You are responsible for reviewing and using AI-generated content appropriately

f) Data Processing:

• AI interactions are processed through OpenAI's API

• OpenAI may retain this data for up to 30 days for service provision and abuse monitoring

• For Chat with AI specifically: Your conversations are sent to OpenAI for content improvement and cannot be opted out

• After 30 days, OpenAI removes data from their systems unless legally required to retain it

• We do not control OpenAI's data retention beyond their stated policies

3.4 Moods Feature:

a) Create fullscreen mood displays to show people in real life

• Customize text, fonts, and background images

• Displays in landscape orientation with profile picture in corner

• Moods are stored locally on your device

• We are not responsible for how others perceive or react to your displayed moods

4. User Accounts and Security

​

4.1 You are responsible for:

​

a) Maintaining the confidentiality of your account credentials

b) All activities that occur under your account

c) Configuring your privacy settings according to your preferences

d) Managing your blocked contacts list

e) Ensuring the security of your device and the App installed on it

​

4.2 You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

​

4.3 We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

5. User Conduct

​

5.1 You agree to use the App in compliance with all applicable laws and regulations in India.

​

5.2 You will not:

​

a) Use the App for any illegal purposes

b) Harass, bully, intimidate, or defame other users

c) Share or promote inappropriate, offensive, or explicit content

d) Impersonate others or provide false information

e) Attempt to gain unauthorized access to the App or its systems

f) Interfere with or disrupt the App or servers or networks connected to the App

g) Transmit any viruses, worms, or other malicious code

h) Collect or store personal data about other users without their consent

i) Use the App in any manner that could damage, disable, overburden, or impair it

k) Create multiple accounts for deceptive or malicious purposes

l) Use automated methods or bots to interact with the App

m) Engage in spamming or excessive messaging that disrupts the experience of other users

n) Exploit the App's features to circumvent any limitations or restrictions

o) Post content that violates community standards similar to major social media platforms (Instagram, Snapchat, etc.)

p) Post nudity, sexually explicit content, or adult content

q) Post content promoting violence, self-harm, dangerous activities, or illegal substances

r) Post content that infringes on others' privacy or contains personal information without consent

s) Create fake or misleading Alt profiles for impersonation purposes

t) Attempt to identify or expose other users' Alt profile identities without consent

u) Use Alt profiles to harass, stalk, or abuse other users

v) Post spam, clickbait, or engagement bait content

w) Share misinformation or deliberately false information

6. Content on our app

​

6.1 Post Content:

​

a) You are solely responsible for all posts, images, comments, and content you share through the App from both your Real and Alt profiles

b) Posts are stored on our servers and may be visible to other users based on your privacy settings

c) We do not guarantee preservation of your posts indefinitely

d) Deleted posts may remain cached on other users' devices temporarily

e) Content posted from Alt profiles maintains anonymity from other users but is linked to your account in our systems

6.2 Prohibited Content:

​

You agree not to send or share content that:

a) Infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights

b) Violates any law or regulation

c) Is defamatory, obscene, pornographic, vulgar, or offensive

d) Promotes discrimination, bigotry, racism, hatred, harassment, or harm

e) Is violent or threatening

f) Promotes illegal activities or substances

g) Contains software viruses or any other computer code designed to disrupt, damage, or limit the functioning of any computer software or hardware

h) Contains unsolicited or unauthorized advertising, promotional materials, spam, chain letters, or other forms of solicitation

i) Content that violates the community guidelines of major social media platforms such as Instagram, Snapchat, and similar services

j) Nudity or sexually suggestive content involving minors

k) Graphic violence or gore

l) Content that encourages or glorifies eating disorders, self-harm, or suicide m) False information intended to deceive or mislead others

6.3 Content Removal:

​

a) We reserve the right to remove any content that violates these Terms

b) We may terminate accounts that repeatedly share prohibited content

c) We may report illegal content to appropriate authorities

​

6.4 AI-Generated Content:

​

a) Content generated through AI features is provided for informational and entertainment purposes only

b) We do not guarantee the accuracy, completeness, or usefulness of AI-generated content

c) You are responsible for reviewing and editing any AI-generated content before sharing it with others

d) You retain responsibility for all content you share, regardless of whether it was generated using AI features

7. Privacy and Data Handling

​

7.1 Data Storage:

​

a) Posts and content are stored on our servers

b) Posts, comments, and user-generated content are stored on our servers
c) We may implement periodic cleanup of inactive or old content
d) Local data such as notes, moods, and preferences are stored on your device
e) Uninstalling the app will result in permanent loss of local data
f) Alt profile linkage to Real profiles is stored securely on our servers for account management
g) Game statistics, leaderboard data, and rankings are stored on our servers

h) Photo AI processing may temporarily store uploaded images for transformation purposes

7.2 User Information:

​

a) Your Real profile information (username, profile picture, etc) will be visible to other users based on privacy settings
b) Your Alt profile is designed to be anonymous to other users, but you control what information you share
c) We maintain the linkage between your Real and Alt profiles for account security and moderation purposes
d) Other users cannot see that your Real and Alt profiles are connected
e) Your posts, likes, and comments are visible based on which profile you use and your privacy settings

7.3 User Status:

​

a) Your online/offline status may be visible to other users by default

b) Active status can be hidden through privacy settings

c) Custom offline indicators are visible to your contacts

d) The App records certain usage statistics to provide message other features

8. AI Features

​

8.1 Chat with AI:

a) AI responses are generated automatically and may contain inaccuracies or inappropriate content

b) CRITICAL: All interactions with Chat with AI are sent to OpenAI for content improvement and service enhancement. This data sharing is mandatory and cannot be disabled. By using Chat with AI, you explicitly consent to this data sharing

c) If you do not consent to this data sharing with OpenAI, you must not use the Chat with AI feature

8.2 Photo AI:

a) Upload your image and apply AI-powered style transformations

b) Processed images are temporary and may be stored briefly for processing

c) You retain ownership of uploaded images but grant us license to process them through AI services

d) Transformation results may vary and are not guaranteed to match expectations

e) We are not responsible for unexpected or undesirable transformations

f) Uploaded images are processed through third-party AI services

 

8.3 Notes with AI:

a) Write personal notes within the app

b) Use AI to generate note content based on your prompts

c) Use AI to summarize your existing notes

d) Notes are stored locally on your device

e) AI-generated notes may be incomplete, inaccurate, or require editing

f) We are not responsible for lost notes due to app deletion or device issues

 

8.4 AI General Disclaimer:

a) All AI features are provided "as is" and may contain errors, limitations, or inaccuracies

b) AI-generated content should not be considered professional advice or absolute truth

c) You are responsible for reviewing and verifying any AI-generated content before relying on it

d) We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any purpose

 

8.5 API Data Handling:

a) AI interactions are processed through OpenAI's API service

b) For Chat with AI: Conversations are sent to OpenAI for content improvement purposes. This cannot be opted out and is required to use the feature

c) For other AI features: Data sent to OpenAI is subject to their data retention policies:

• OpenAI may retain data for up to 30 days

• Data is used for service provision and abuse monitoring

• Access is restricted to authorized personnel

• SOC 2 Type 2 compliance standards are maintained

d) After 30 days, OpenAI removes data from their systems unless legally required to retain it

e) We do not control OpenAI's data handling beyond ensuring our integration follows security best practices

9. Intellectual Property Rights

​

9.1 The App and its original content, features, and functionality are and will remain the exclusive property of Sircle Networking Pvt Ltd and its licensors.

9.2 The App is protected by copyright, trademark, and other laws of India and foreign countries.

9.3 Our trademarks and trade dress may not be used without our prior written consent.

9.4 You retain ownership of content you create or share through the App, but grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, display, reproduce, and modify such content to provide our services.

10. Third-Party Links and Services

​

10.1 The App may contain links to third-party websites or services not owned or controlled by us.

10.2 We assume no responsibility for third-party content, privacy policies, or practices.

10.3 You acknowledge that we shall not be responsible for any damage caused by third-party services.

10.4 AI features may utilize third-party services for language processing, translation, or web search. We are not responsible for the accuracy or availability of these third-party services.

11. Termination

​

11.1 We may terminate or suspend your account immediately:

​

a) For any breach of these Terms

b) For prolonged inactivity

c) For abusive behavior

d) At our sole discretion

11.2 Upon termination:

​

a) Your right to use the App will cease immediately

b) Your posts may be removed from the platform

c) Both your Real and Alt profiles will be deactivated

d) Local data (notes, moods) will be lost

e) Your leaderboard rankings and game data may be removed

f) Your account data may be deleted from our servers after a period of time

​

12. Indemnification

​

You agree to defend, indemnify, and hold harmless Sircle Networking Pvt Ltd, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

a) Your use of the App

b) Your violation of these Terms

c) Your violation of any third-party right

d) Your messages, posts, comments, or shared content

e) Your interactions with other users

f) Your use of AI-generated content​​
