1. Acceptance of Terms

​

1.1 By downloading, installing, accessing, or using Convoh Messenger(hereinafter referred to as "the App"), you agree to be bound by these Terms of Service (hereinafter referred to as "Terms"). If you do not agree to these Terms, please do not use the App.

​

1.2 These Terms constitute a legally binding agreement between you and Sircle Networking Pvt Ltd (hereinafter referred to as "we," "us," or "our") regarding your use of the App.

​

2. Eligibility

​

2.1 The App is available only to users in India who are 13 years of age or older. By using the App, you represent and warrant that:​

​

a) You are at least 13 years old;

b) You reside in India;

c) You have the legal capacity to enter into these Terms and be bound by them.

​

2.2 If you are using the App on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

​

3. App Features and Services

​

3.1 Messaging Features:

​

a) The App provides the following messaging capabilities:

• Direct messaging between users (text, image, video, file, and GIF sharing)

• Group chats (with a limit of 100 members per group)

• Timer texts (scheduled messages)

• Disappearing groups (24 hours, 7 days, and 30 days durations)

• Story sharing (TextStory, Image story, and Video stories with 24-hour expiration)

• Media sharing (images, videos, files, and GIFs)

• User following system to view stories

• User blocking capabilities

• User search and contact synchronization

• Custom offline indicators (Ghosting, Inactive, Chilling, Brb, and Away)

• Active status controls

• User visibility settings

• Message badges based on usage (stored locally)

• Customizable chat and home screen wallpapers

• Multiple language support (English, Hindi, Telugu, Marathi, Gujarati, and Bengali)

• Dark and light mode options

• Multiple theme options (Normal, Pastel, Matcha, Lavender, and ButterBliss)

• Discover access to anonymous and trending stories from other users

• Anonymous story creation with identity protection

• Trending story viewing based on whats trending

• Translation services (10 daily translations via AI)

• Fact-checking services (10 daily fact-checks with web search via AI)

b) Timer Texts and Disappearing Groups Disclaimer:

• Timer texts and disappearing groups are provided on a "best effort" basis

• We do not guarantee the delivery of timer texts at the exact specified time

• We do not guarantee that disappearing groups will be deleted at the exact specified time

• Various factors including network connectivity, device status, system limitations and other factors may affect these features

• We are not liable for any consequences resulting from delayed, failed, or improperly timed message delivery or group deletion

c) Group Chat Limitations:

• Group chats are limited to 100 members per group

• Only group administrators can add or remove members

• Disappearing groups have set durations of 24 hours, 7 days, or 30 days

• Content shared in disappearing groups may persist on recipients' devices

​

d) Story Limitations:

• All stories expire after 24 hours

• Stories are visible only to users who follow you

• We do not guarantee the delivery of stories to all followers

​

e) Language Support Disclaimer:

• The App offers support for multiple languages (English, Hindi, Telugu, Marathi, Gujarati, and Bengali)

• Language translations are powered by AI technology and may contain inaccuracies

• We are not responsible for any misinterpretation or miscommunication resulting from translation errors

​

3.2 AI-Powered Features:

​

a) The App incorporates AI-powered features from App ai, including:

• Chat with AI (Smart mode with limited web search capabilities and Work mode for STEM-focused assistance)

• AI-powered dictionary with Word of the Day feature

• CIPHER word game

• Compose with AI for creating various types of text content

• AI-powered notes app

• Pet AI with customizable options

• Translation with AI for message and content translation

• Fact-checking with web search for information verification

b) Smart Mode Limitations:

• Smart mode allows up to 5 web search queries per day

• After reaching this limit, the app switches to a different AI model without web search capabilities

• Web search results may not be comprehensive or fully up-to-date

​

c) AI Disclaimer:

• These features are powered by artificial intelligence technology

• You acknowledge that these AI features are provided "as is" and may be subject to limitations or errors

• Information provided by the AI should not be considered as professional advice or absolute truth

• AI translations may contain inaccuracies, and we are not responsible for any miscommunication resulting from translation errors

d) Data Processing:

• Your interactions with AI features are processed through OpenAI's API

• OpenAI may retain this data for up to 30 days for service provision and abuse monitoring

• After 30 days, OpenAI removes this data from their systems unless legally required to retain it

• OpenAI limits access to this data to authorized employees and specific contractors for legitimate business purposes

• We do not control OpenAI's data retention or processing beyond their stated policies

3.3 Privacy Features:

​

a) Users can control their privacy through various settings:

• Hidden visibility option

• Active status controls

• Profile visibility controls

• Blocking other users

• Custom offline indicators

b) Privacy settings are user-controlled and must be configured manually

c) Default settings may make your information visible to other users​​​​

3.4 Coin System:

a) The App includes a coin-based rewards system with the following features:
   • Five tier levels: Bronze, Silver, Gold, Platinum, and Diamond
   • Daily coin allowances based on tier level
   • Coins earned through app usage, daily logins, streaks, and other activities
   • Coins required for using certain AI features
   • Transaction history tracking of coin earnings and spending

b) Coin System Limitations:
   • Coins have no monetary value and cannot be exchanged for money
   • Coin balances are stored locally on your device
   • We reserve the right to modify coin earning rates and feature costs
   • Some AI features may require both sufficient coins and minimum tier levels
   • Transaction history is limited to the most recent 50 transactions

3.7 Discovery and Content Features:

a) DiscoverScreen Functionality:

• Provides access to anonymous stories and trending content from across the platform

• Content is algorithmically curated based on engagement and other factors

• Users can view but not identify creators of anonymous stories

b) Anonymous Stories:

• Users can post stories without revealing their identity to other users

• Stories appear as "@anon" with randomized avatars to viewers

• Important: While your identity is hidden from other users, we retain your actual identity information for content moderation, abuse prevention, and legal compliance

• All content policies apply equally to anonymous stories

c) Trending Stories:

• Stories may be automatically designated as "trending" based on our algorithms

• Trending status is determined by engagement metrics, timing, and content analysis

• We reserve the right to modify or remove trending designations

d) Translation and Fact-Checking:

• AI-powered translation available with 10 daily uses

• AI-powered fact-checking with web search, 10 daily uses

• Both features process content through OpenAI's services

• Results are for informational purposes only and may contain inaccuracies

• Users must verify important information independently

4. User Accounts and Security

​

4.1 You are responsible for:

​

a) Maintaining the confidentiality of your account credentials

b) All activities that occur under your account

c) Configuring your privacy settings according to your preferences

d) Managing your blocked contacts list

e) Ensuring the security of your device and the App installed on it

​

4.2 You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

​

4.3 We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

​

4.4 Account badges are determined automatically based on local usage data and do not represent any official status or endorsement by us.

​

5. User Conduct

​

5.1 You agree to use the App in compliance with all applicable laws and regulations in India.

​

5.2 You will not:

​

a) Use the App for any illegal purposes

b) Harass, bully, intimidate, or defame other users

c) Share or promote inappropriate, offensive, or explicit content

d) Impersonate others or provide false information

e) Attempt to gain unauthorized access to the App or its systems

f) Interfere with or disrupt the App or servers or networks connected to the App

g) Transmit any viruses, worms, or other malicious code

h) Collect or store personal data about other users without their consent

i) Use the App in any manner that could damage, disable, overburden, or impair it

j) Attempt to circumvent any timing mechanisms for timer texts or disappearing groups

k) Create multiple accounts for deceptive or malicious purposes

l) Use automated methods or bots to interact with the App

m) Engage in spamming or excessive messaging that disrupts the experience of other users

n) Exploit the App's features to circumvent any limitations or restrictions

6. Content and Messages

​

6.1 Message Content:

​

a) You are solely responsible for all messages, media, and content you send through the App

b) Messages are stored on our servers for a limited period (up to 60 days) and locally on your device

c) We do not guarantee the preservation or security of your messages beyond this period

d) Timer texts and disappearing messages may not be delivered or may be delivered at unexpected times

e) Stories expire after 24 hours and may not be accessible after this period

​

6.2 Prohibited Content:

​

You agree not to send or share content that:

a) Infringes on any patent, trademark, trade secret, copyright, or other intellectual property rights

b) Violates any law or regulation

c) Is defamatory, obscene, pornographic, vulgar, or offensive

d) Promotes discrimination, bigotry, racism, hatred, harassment, or harm

e) Is violent or threatening

f) Promotes illegal activities or substances

g) Contains software viruses or any other computer code designed to disrupt, damage, or limit the functioning of any computer software or hardware

h) Contains unsolicited or unauthorized advertising, promotional materials, spam, chain letters, or other forms of solicitation

6.3 Content Removal:

​

a) We reserve the right to remove any content that violates these Terms

b) We may terminate accounts that repeatedly share prohibited content

c) We may report illegal content to appropriate authorities

​

6.4 AI-Generated Content:

​

a) Content generated through AI features is provided for informational and entertainment purposes only

b) We do not guarantee the accuracy, completeness, or usefulness of AI-generated content

c) You are responsible for reviewing and editing any AI-generated content before sharing it with others

d) You retain responsibility for all content you share, regardless of whether it was generated using AI features

7. Privacy and Data Handling

​

7.1 Data Storage:

​

a) Messages and content are stored on our servers for up to 60 days

b) We have plans to implement regular cleanup of servers every 60 days

c) Local data such as message badges and wallpaper preferences are stored on your device

d) Uninstalling the app will result in permanent loss of local data

e) AI-generated content in notes, compose, and timer texts may be stored locally on your device

​f) Coin system data:
   • Coin balances and transaction history are stored locally on your device
   • Tier status is calculated based on lifetime coin accumulation
   • Transaction records may be limited to a certain number of recent transactions
   • This data may be lost if you uninstall the app or clear app data

g) Discovery and Feature Data:

• Anonymous story metadata stored on servers (with user identification for moderation)

• Trending algorithms and engagement metrics

• Translation and fact-checking usage counts (stored locally)

• Discovery interaction patterns and preferences

7.2 User Information:

​

a) User profiles, including username, will be visible to other users by default

b) Users can modify privacy settings to control their visibility

c) We do not share your contact information with third parties except as required for the functioning of the App

​

7.3 User Status:

​

a) Your online/offline status may be visible to other users by default

b) Active status can be hidden through privacy settings

c) Custom offline indicators are visible to your contacts

d) The App records certain usage statistics to provide message badges and other features

​

8. Timer Texts and Disappearing Groups

​

8.1 Timer Texts:

​

a) Are provided on a best-effort basis

b) May fail to deliver at the exact specified time

c) Require active internet connection and running app

d) May be affected by device settings, battery optimization, or system limitations

e) Are stored on our servers until delivery or for a maximum of 60 days

 

8.2 Disappearing Groups:

​

a) May not delete exactly at the specified time (24 hours, 7 days, or 30 days)

b) Require all group members to have active internet connection for synchronization

c) May be affected by system limitations or technical issues

d) Content shared in disappearing groups may persist on recipients' devices even after the group disappears

​

8.3 Liability Limitation:

​

a) We are not responsible for failed or delayed timer text delivery

b) We are not liable for any consequences of timing inconsistencies

c) Users should not rely on these features for time-critical communications

d) No refunds or compensation will be provided for feature failures

e) We do not guarantee that deleted content is completely removed from all devices or servers

​

9. Story Features

​

9.1 Story Types and Limitations:

​

a) The App supports three types of stories: TextStory, Image story, and Video stories

b) All stories expire and are automatically deleted after 24 hours

c) Stories are only visible to users who follow you

d) We do not guarantee delivery or visibility of stories to all followers

​

9.2 Story Content:

​

a) You are solely responsible for the content of your stories

b) Stories must comply with our content policies as outlined in Section 6.2

c) We reserve the right to remove stories that violate our policies

​

10. AI Features

​

10.1 AI Chat Limitations:

​

a) Smart mode allows up to 5 web search queries per day per user

b) After reaching this limit, the app switches to a model without web search capabilities

c) Work mode is optimized for STEM-focused assistance but has technical limitations

d) AI responses are generated automatically and may contain inaccuracies or inappropriate content

​e) AI features require coins to use, with costs varying by feature:
   • Smart mode web searches have higher coin costs than standard AI chat
   • Higher tier users receive larger daily coin allowances
   • Certain AI features may require minimum tier levels to access

​

10.2 AI-Powered Dictionary and Word Game:

​

a) Dictionary definitions and examples are generated using AI and may not match official dictionary definitions

b) Word of the Day is selected automatically and may not be customized

c) The CIPHER word game uses AI to suggest words based on difficulty levels

d) We do not guarantee the accuracy of word definitions or game suggestions

10.3 AI Compose and Notes:

a) Content generated through these features is for personal use only

b) We do not claim ownership of AI-generated content, but you are responsible for how you use it

c) AI-generated content may be incomplete, inaccurate, or inappropriate in some contexts

d) We recommend reviewing and editing AI-generated content before using it for important purposes

10.4 Pet AI:

​

a) Pet AI provides simulated interactions and is not a substitute for professional advice

b) Pet AI responses are generated automatically and do not represent our opinions or advice

c) We are not responsible for any actions taken based on Pet AI interactions

​

10.5 API Data Handling:

​

a) All AI interactions are processed through OpenAI's API service

b) Data sent to OpenAI is subject to their data retention policies:

• OpenAI may retain data for up to 30 days

• Data is used for service provision and abuse monitoring

• Access is restricted to authorized personnel

• SOC 2 Type 2 compliance standards are maintained

c) We do not have mechanisms to request zero data retention from OpenAI unless you have a qualifying use case, which would require a direct arrangement with OpenAI

d) We are not responsible for OpenAI's handling of data beyond ensuring our integration follows best practices for security

11. Intellectual Property Rights

​

11.1 The App and its original content, features, and functionality are and will remain the exclusive property of Sircle Networking Pvt Ltd and its licensors.

11.2 The App is protected by copyright, trademark, and other laws of India and foreign countries.

11.3 Our trademarks and trade dress may not be used without our prior written consent.

11.4 You retain ownership of content you create or share through the App, but grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, display, reproduce, and modify such content to provide our services.

12. Third-Party Links and Services

​

12.1 The App may contain links to third-party websites or services not owned or controlled by us.

12.2 We assume no responsibility for third-party content, privacy policies, or practices.

12.3 You acknowledge that we shall not be responsible for any damage caused by third-party services.

12.4 AI features may utilize third-party services for language processing, translation, or web search. We are not responsible for the accuracy or availability of these third-party services.

13. Termination

​

13.1 We may terminate or suspend your account immediately:

​

a) For any breach of these Terms

b) For prolonged inactivity

c) For abusive behavior

d) At our sole discretion

​

13.2 Upon termination:

​

a) Your right to use the App will cease immediately

b) Local data may be lost permanently

c) Timer texts will not be delivered

d) Groups you created may be disbanded

e) Your stories will be removed

f) Your account data may be deleted from our servers after a period of time

​

14. Indemnification

​

You agree to defend, indemnify, and hold harmless Sircle Networking Pvt Ltd, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

a) Your use of the App

b) Your violation of these Terms

c) Your violation of any third-party right

d) Your messages, stories, or shared content

e) Your interactions with other users

f) Your use of AI-generated content
